ArcBest Booking Request Terms and Conditions

ArcBest arranges transportation services under this Pricing Schedule as a Freight Forwarder and an independent contractor to you. Service Provider(s) hired by ArcBest to perform services for you are only non-agent independent contractors to ArcBest. The term "you" used herein shall mean the shipper, consignee or third party payor, as applicable. Any expense to service provider for loading (including any necessary blocking and bracing) or unloading service will be assessed against the payor of the freight charges, in addition to all other charges, when the quoted price is subject to: (1) shipper load and count and the service provider incurs loading expense; and/or (2) consignee unload and the service provider incurs unloading expense. The rate(s) herein will take precedence over any otherwise applicable rate, charge or quotation, whether in a tariff or contract. This shipment(s) will not be eligible for any other form of rate reduction, including discounts, allowances and incentive programs. Intermodal shipments are subject to all applicable railroad service directories and the AAR rules that outline the proper packaging, blocking, and bracing of a shipment. Unless otherwise noted, the rate herein does not include applicable charges for special services performed, fuel surcharges, or accessorial charges.

AT ARCBEST'S SOLE OPTION, IT MAY REFUSE TO APPLY THIS PRICING SCHEDULE TO SHIPMENTS WHICH DO NOT MATCH THE EXACT PRICING SCHEDULE SPECIFICS SHOWN ABOVE OR WHICH DO NOT REFERENCE THE PRICING SCHEDULE NUMBER ON THE ORIGINAL BILL OF LADING.

You will receive two (2) hours of free time at both the origin and destination, but when the carrier driver is delayed past such free time, detention charges will be applicable. Once a carrier driver is dispatched on your load hereunder, if shipment cancellation occurs within twenty-four (24) hours of the scheduled pickup time, you will be charged a truck ordered but not used fee.

Unless provided otherwise in tariff ARC 111, ArcBest, carriers and any service providers' aggregate cargo liability for any loss and/or damage to cargo occurring as to any shipment and transportation services hereunder is limited to the lesser of: (1) the actual value of the goods lost or damaged; (2) $2.00 Canadian per pound per lost or damaged package for any Canadian origin shipment; (3) $5.00 ($0.10 for any item other than new) per pound per lost or damaged package; or (4) $100,000.00 per trailer. Neither ArcBest, carriers nor any service providers shall be liable for any cargo loss and/or damage occurring on shipments originating in or destined to Mexico. ArcBest' offered pricing is based upon certain cargo liability limitations as set forth herein. Optional excess cargo liability is available at an additional expense when requested prior to pickup but must have been requested and indicated herein and in the body of the bill of lading or in the body of the bill of lading if published pricing is applicable to the shipment. Excess liability coverage can only be requested as provided herein and per the instructions stated in tariff ARC 111 series which is available on request to ArcBest or at www.arcb.com. To request ELC, call 877.279.8090 prior to the shipment being picked up. The parties acknowledge and agree that liability is limited in consideration of a lower rate than would otherwise be applicable. Neither ArcBest, carriers nor any service providers shall be liable for indirect, incidental, special, consequential, punitive, multiplied or any other indirect cost, fees, charges or from delays of any kind arising from performance of services under this Pricing Schedule, whether or not foreseeable or disclosed.

By accepting services hereunder, you agree to the terms, conditions, and pricing contained in the following documents, and the following order of precedence will apply if such documents have inconsistent provisions: (1) ArcBest Pricing Schedule; (2) ArcBest ARC-111 Series tariff (available upon request or at arcb.com); (3) ArcBest Bill of Lading. All the foregoing documents are herein incorporated by reference. Shipments hereunder will be governed by U.S. federal laws, regulations and preemption, and in the absence of U.S. federal laws, regulations and preemption, then, the laws of the State of Arkansas shall govern, and venue shall be in a court located in Sebastian County, Arkansas.

ArcBest provides quotations, invoicing, billing, claims and other administrative services to customers of affiliate companies as an agent pursuant to an agreement between the companies.
