California Residents
The California Consumer Privacy Act of 2018 (“CCPA”) as amended and expanded by the California Privacy Rights Act of 2020 (“CPRA”) provides California residents (referred to in this section as “consumers”) with certain rights concerning their personal information. This section applies only to California residents who interact with ArcBest for non-employment purposes. I. Collection and Use of Personal Information
A. Categories of Personal Information We Collect:
The following categories of personal information are the categories we collect for consumers who interact with us for non-employment-related purposes, including any consumers who have interacted with us during the previous twelve (12) months).
- Identifiers (e.g., real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, social security number, driver's license number, passport number, or other similar identifiers)
- Information that identifies, relates to, describes, or is capable of being associated with, a particular individual, including, but not limited to, his or her name, signature, social security number, physical characteristics or description, address, telephone number, passport number, driver's license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information.
- Commercial information (e.g., records of personal property, products or services purchased, obtained, or considered,)
- Internet or other electronic network activity information (e.g., browsing history, search history, and information regarding a consumer's interaction with an Internet Web site, application, or advertisement)
- Geolocation data – we do not collect “precise geolocation” data.
- Audio, electronic, visual, or similar information
B. How Long We Retain Personal Information
Personal Information is retained for only as long as necessary to perform the purposes set forth in this Privacy Policy or to comply with legal requirements and ArcBest internal policy.
C. How We Collect Personal Information
Directly from consumers – for example, through interactions with ArcBest via telephone or email and through a consumer’s interactions with our websites and web or mobile applications.
D. Business Purpose for Collecting Personal Information
ArcBest collects personal information for the following business purposes:
- To perform services requested by consumers and to verify their information
- To communicate with consumers about services including, but not limited to, providing accurate rates and service-related information and processing payment for services.
- Undertaking internal research for technological development and demonstration
- Undertaking activities to verify or maintain or improve the quality of our services, websites, and applications
- Helping to ensure security and integrity
- Performing marketing and advertising services
ArcBest does not collect or process Sensitive Personal Information (as that term is defined in the CPRA) for the purpose of inferring characteristics about consumers.
E. Categories of Information Disclosed to Third Parties for a Business Purpose
The categories of third parties to whom personal information is disclosed for a business purpose includes our affiliated entities (i.e. ArcBest subsidiaries and affiliates), government agencies, and, upon a consumer’s direction or request, third-party service providers. This personal information is disclosed as necessary to comply with applicable laws, rules, regulations, subpoenas, or court or administrative orders. It is also disclosed as necessary to provide the services and functions reasonably expected by a consumer who interacts with us for non-employment-related purposes.

F. Categories of Personal Information We Sell or Share
ArcBest may sell or share personal information with third parties for the purpose of cross-context behavioral advertising. These third parties use cookies, pixels, or other tracking technologies to collect information from your interactions with our website or applications. This information allows advertisements for ArcBest services to be presented to you when you visit our website or applications or other websites or applications.

ArcBest has no knowledge of “selling” or “sharing” any personal information of consumers who are under the age of 16.
II. California Consumers Rights and Choices
A. Right to Know and Correct
Consumers have the right to know the categories and specific pieces of personal information ArcBest has collected, sold, shared, or disclosed, and the business purpose for doing so.
Consumers also have the right to request that ArcBest correct inaccurate personal information it maintains. However, ArcBest may deny a correction request if it determines that the personal information in its possession is more likely than not accurate based upon a totality of the circumstances. ArcBest may require the consumer to provide documentation to support their correction request.

B. Right to Opt-Out of Sale or Sharing of Personal Information
Consumers have the right to direct ArcBest not to sell or share any of their personal information.

C. Deletion Rights
Consumers have the right to request that ArcBest delete their personal information that it has collected and retained subject to certain exceptions. Such exceptions include, but are not limited to, scenarios in which the personal information is required to complete the transaction for which the personal information was collected, complying with legal obligations, or for internal uses that are reasonably aligned with the consumer’s expectations based upon their relationship with us.
D. Right to Limit Use and Disclosure of Sensitive Personal Information
When a business collects sensitive personal information for the purpose of inferring characteristics about a consumer, the consumer has the right to direct the business to limit its use and disclosure of such sensitive personal information to only the uses necessary to perform the services or to provide the goods reasonably expected by an average consumer requesting the goods or services.
ArcBest does not collect any sensitive personal information for the purpose of inferring characteristics about consumers. As such, the right to limit use and disclosure of sensitive personal information does not apply to information collected from consumers; however, the previously mentioned rights to know, correct, opt-out, and delete are still applicable.
III. Exercising Your Rights
Consumers can exercise their Rights to Know, Correct, Opt-out, and Delete, by submitting a verifiable request to ArcBest by emailing privacy@arcb.com or mailing their request to ArcBest II, Inc., Attn: Customer Experience, P.O. Box 10048, Fort Smith, AR 72917. Consumers may also contact us at 479-785-8920.
Only the consumer, or someone legally authorized to act on the consumer’s behalf, may make a verifiable request related to their personal information. Consumers may only make a verifiable request for access or data portability twice within a 12-month period. Before providing any requested information, ArcBest will require consumers to provide certain information in order to verify their identity or authority to make the request.
ArcBest endeavors to respond to requests within forty-five (45) days of receipt. If more time is required (up to 90 days), ArcBest will provide the reason and extension period in writing. If ArcBest denies your request for any reason, it will provide an explanation in its response to you.
ArcBest does not charge a fee to process or respond to verifiable requests unless it is excessive, repetitive, or manifestly unfounded. If ArcBest determines that the request warrants a fee, it will explain that decision and will provide a cost estimate before completing the request.
IV. Non-Discrimination/Non-Retaliation
When consumers interact with ArcBest or its websites for purposes other than employment, ArcBest will not discriminate or retaliate against consumers for exercising any of their rights under the CCPA/CPRA. Unless permitted by the CCPA/CPRA, ArcBest will not:
- Deny goods or services.
- Charge different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide a different level or quality of goods or services.
- Suggest that a consumer may receive a different price or rate for goods or services or a different level or quality of goods or services.
Colorado Residents
You have rights regarding our access and use of your data according to the Colorado Privacy Act. Colorado residents have rights to request the following:
- To opt out of the sale, targeted advertising, or sale of their personal information;
- To access your personal data and obtain that information in a readily accessible format;
- To correct inaccuracies in your personal data; and
- To delete your personal data.
The rights to Colorado residents under this section do not apply to an individual acting in an employment context or to a job applicant. You may authorize someone to initiate a request on your behalf. However, we will need to use reasonable efforts to identify you and the person that you authorize to act on your behalf.
We will endeavor to respond to your request within forty-five days of its submission. If we need longer time to respond, we will inform you and the reason why we need additional time.
Utah Residents
You have rights regarding our access and use of your data according to the Utah Consumer Privacy Act. Utah residents have rights to request the following:
- Access and confirm whether we are processing your personal data;
- To request that we delete your personal data;
- To obtain a copy of your personal data in a readily usable and accessible format;
- To opt of the sale or processing of your personal data for targeted advertising

A parent or legal guardian may submit a request on behalf of their child or ward. We shall endeavor to respond to your request withing forty-five days of its submission. We may request an additional forty-five day extension when necessary. We will let you know the basis of any extension. If we do not act upon your request, we will inform you of the reason for our refusal. We may charge a fee if you submit a subsequent request within a twelve-month period.
Virginia Residents
Pursuant to the Virginia Data Privacy Act of 2021, Virginia residents have certain rights with respect to their personal information. Specifically, Virginia residents have the right to request the following:
- Access to their personal information;
- To Correct their personal information;
- To Delete their personal information; and
- To Opt-Out of the sale of their personal information.
These rights apply only to personal information collected or processed in an individual or household context. They do not apply to personal information of Virginia residents that collected or processed in a commercial or employment context.
