How does ArcBest safeguard personal information?
We employ physical, administrative and technical safeguards and security techniques designed to appropriately protect confidential information from unauthorized access, use, and disclosure.
Although we work hard to protect personal information that we collect and store, the Internet is not 100% secure and we cannot guarantee or warrant that our safeguards will prevent every unauthorized attempt to access, use or disclose your information; therefore, we are not responsible for any damages or liabilities relating to any such incidents to the fullest extent permitted by law.
Because of the nature of transportation and logistics services and the varied parties involved in providing services to you, we cannot maintain complete confidentiality of information that is printed and placed in plain view on a shipment or package or that is required to be disclosed in order to arrange, perform, or manage services for you.
How long does ArcBest retain personal information?
Personal information is retained for only as long as necessary to perform the purposes set forth in this Privacy Policy or to comply with legal requirements and ArcBest internal policy.
How do I change my personal or company information?
Registered users may: (1) contact their ArcBest representative, or (2) e-mail passwords@arcb.com to request a change to registration information. You are entirely responsible for any and all activities that occur under your account.
Personal information provided at the time of registration may be deleted if the user does not access the website within 6 months as a logged-on user.
How do I opt-out of promotional materials?
Registered users and existing customers at times may receive newsletters and other promotional materials via e-mail. Each email provides clear instructions on how to opt-out of future e-mails. Furthermore, print materials are sent to existing customers on a regular basis. You may also opt-out of these print mailings by contacting your ArcBest representative.
What rights do I have in my personal information?
Depending on where you live, you may have certain rights relating to your personal information. Those rights include:
- Right to Know. You have the right to confirmation whether we are processing your personal information and to know the categories of personal information ArcBest has collected, the categories of sources, the business or commercial purpose for collecting, selling, or “sharing” personal information, the categories of third parties to whom we disclosed your information, and the specific pieces of personal information we have collected about you in a readily accessible format.
- Right to Correct. You have the right to request that we correct inaccurate personal information. However, ArcBest may deny a correction request if it determines that the personal information in its possession is more likely than not accurate based upon a totality of the circumstances. We may ask you to provide documentation to support a correction request.
- Right to Delete. You may ask us to delete your personal information in our systems. However, this right is subject to certain exceptions, including, but not limited to, scenarios in which the personal information is required to complete the transaction for which the personal information was collected, complying with legal obligations, or for internal uses that are reasonably aligned with the consumer’s expectations based upon their relationship with us.
- Right to Opt-Out of Sale or Sharing. Consumers have the right to direct ArcBest not to sell or “share” any of their personal information. To opt-out of tracking, see the section titled “How do I opt-out of tracking” above.
To exercise the right to Know, Correct, or Delete, please submit a verifiable consumer request by emailing privacy@arcb.com or mailing your request to ArcBest II, Inc., Attn: Customer Experience, P.O. Consumers may only make a verifiable request for access or data portability twice within a 12-month period. Before providing any requested information, ArcBest will require consumers to provide certain information in order to verify their identity or authority to make the request.
ArcBest endeavors to respond to requests within forty-five (45) days of receipt. If more time is required (up to 90 days), ArcBest will provide the reason and extension period in writing. If ArcBest denies your request for any reason, it will provide an explanation in its response to you.
ArcBest does not charge a fee to process or respond to verifiable requests unless it is excessive, repetitive, or manifestly unfounded. If ArcBest determines that the request warrants a fee, it will explain that decision and will provide a cost estimate before completing the request.
If you reside in California, you can have an authorized agent submit a Right to Know, Correct, or Delete request on your behalf. If you choose to use an agent, and the agent does not have power of attorney under the California Probate Code, we cannot process the request until:
- The agent provides a copy of your signed permission authorizing the agent to make the request;
- You verify your identity directly with us; or
- You provide us direct confirmation that you provided the agent permission to submit the request.
Does ArcBest collect information about children?
Our website is not intended for children under 16 years of age. No one under age 16 may provide any information to or on our website. We do not knowingly collect personal information from children under 16. If you are under 16, do not use this site.
Will ArcBest make changes to this Policy?
ArcBest may review and update this Privacy Policy without prior notice. If we change this Privacy Policy, the updated policy will be posted to this page and the date first written above shall indicate its effective date.
