OFFICIAL RULES
Official start and end of each sweepstakes or contest (“Promotion”) will adhere to time and date listed in the Promotion announcement found on the applicable social media network(s) (e.g. Facebook, Twitter) (the “Network”). Official Promotion entries will be accepted only through the Network. HOW TO ENTER: NO PURCHASE NECESSARY. VOID WHERE PROHIBITED BY LAW. To enter, go to www.facebook.com/arcbestcorp or www.twitter.com/arcbestcorp, follow the instructions, and click submit during the entry period. You may only enter a Promotion online. No other method of entry will be accepted. Only one entry per person per day per email address. All entries become the property of Sponsor and none will be returned. INCOMPLETE, INACCURATE, GARBLED, UNINTELLIGIBLE OR ILLEGIBLE ENTRIES OR RESPONSES WILL RESULT IN AN INVALID PROMOTION REGISTRATION AND WILL BE VOID.
ELIGIBILITY: Promotions are open to legal residents of the U.S. (except where prohibited by law) that are eighteen (18) or older as of the date of entry. By participating in the Promotion, each entrant agrees to be bound by these Official Rules and, if a winner, consents to the use of his or her name, city and state of residence, likeness, voice and/or photograph for promotional, advertising and publicity purposes (both online and off-line) related to the Promotion (including promoting, advertising and publicizing the efforts and activities of Sponsor in connection with the Promotion) without additional compensation, unless prohibited by applicable law. Sponsor reserves the right to verify the eligibility qualifications of the winners, and disqualify entrants who do not meet the eligibility requirements set forth in these Official Rules. In the event of a dispute regarding the identity of an online entrant, entries will be declared to have been made by the "Assigned Account Holder," that is, the individual person who is assigned the email address by the Internet Service Provider corresponding to the winning entry. An individual is not eligible to win a Promotion or any subsequent ArcBest Corporation sweepstakes or contest more than once during a 12-month period.
WINNERS DETERMINATION: Winners will be selected from eligible entries as described in each Promotion, which shall be either at random or through the Sponsor’s determination of the first Network user to complete the activity listed in the Promotion post on the Network. The determination of the winner shall be conducted by an independent judge whose decisions are final with respect to all aspects of the Promotion. Such tentative winner will be announced by the official ArcBest Corporation account on the Network through which the Promotion was held or contacted through the Network’s instant messaging feature. Each such tentative winner, at his or her sole discretion, may disclaim the applicable prize by not claiming such prize or by not completing and returning to Sponsor its required Affidavit of Eligibility, Liability Release, and where permitted by applicable law, Publicity Release within fourteen (14) days of attempted notification and in such case an alternate winner will be selected by random drawing from the remaining eligible entries and such process will be repeated until such time as an eligible, tentative winner for each prize completes and returns such documents within the period specified above. At such time, subject to verification by Sponsor, the tentative winner will be deemed the prize winner. Odds of winning the Promotion will depend on the number of eligible entries received during the Entry Period. If an e-mail prize notification is returned as undeliverable, or a tentative winner cannot be contacted, fails to respond or otherwise fails to comply with these Official Rules, such tentative winner may be disqualified at the sole discretion of the Sponsor and an alternate winner will be selected as provided above. If, in Sponsor's opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Promotion, if technical difficulties compromise the integrity of the Promotion, or if the Promotion is otherwise not capable of being conducted as contemplated in these Official Rules, Sponsor reserves the right to terminate, suspend or modify the Promotion. Any attempt to deliberately damage the content or operation of the Promotion is unlawful and subject to legal action by Sponsor or its agents.
PRIZES: Prizes to be awarded and approximate retail values are as stated in the social media post announcing the Promotion. The winner must advise ArcBest Corporation of its preferred shirt size (where applicable) within 14 days of notifications. No substitution or transfer of the prizes or any portion thereof is permitted, except with the permission of Sponsor or where required by applicable law. If a particular prize, or any portion of such prize, becomes unavailable, the Sponsor may award a substitute prize of equal or greater value. All taxes on prizes are the sole responsibility of the applicable winner, and the winner may be required to complete a form W-9. Any fees, costs and expenses not expressly listed herein, is the sole responsibility of the applicable winner. Subject to these Official Rules, all of the prizes will be awarded.
PRIVACY POLICY: All information submitted as part of the Promotion will be treated in accordance with Sponsor's privacy policy. Each entrant's submission of an online entry or an e-mail address, constitutes such entrant's consent for Sponsor to communicate with such entrant by e-mail, and by participating in the Promotion each entrant further authorizes Sponsor to obtain and use such entrant's name, phone number and address for the purpose of administering the Promotion.
WINNERS LIST AND OFFICIAL RULES: To obtain a list of winners, send a self-addressed stamped envelope to: ATTN: ArcBest Corporation, 3801 Old Greenwood Road, Fort Smith, AR 72903 and include the text: ArcBest Corporation Winners List. Requests for winners list (or Official Rules as set forth below) received more than ninety (90) days after the Promotion end date will not be honored. Additional copies of the Official Rules may be obtained by sending a self-addressed stamped envelope to: ATTN: Social Media Promotion, ArcBest Marketing, 3801 Old Greenwood Road, Fort Smith, AR 72903.
SPONSOR: The Sponsor of this Promotion is ArcBest Corporation, 3801 Old Greenwood Road, Fort Smith, AR 72903. The Network is not a sponsor of or affiliated with this Promotion; however, its terms and conditions shall apply to use of the Network.
LIMITATIONS OF LIABILITY:
BY PARTICIPATING IN THE PROMOTION, EACH ENTRANT AGREES TO RELEASE, INDEMNIFY AND DEFEND THE SPONSOR, ITS AFFILIATES, PRIZE SUPPLIERS, JUDGES, PROMOTION AGENCIES AND THEIR RESPECTIVE OFFICERS, DIRECTORS, SHAREHOLDERS, AGENCIES AND EMPLOYEES (COLLECTIVELY, THE "RELEASED PARTIES") FROM AND AGAINST ALL CLAIMS, ACTIONS, INJURY, LOSS OR DAMAGE OF ANY KIND RESULTING FROM OR ARISING OUT OF EACH SUCH ENTRANT'S PARTICIPATION IN THIS PROMOTION AND/OR FROM ACCEPTANCE OR USE OF THE PRIZES AWARDED, SO THAT SPONSOR AND SUCH OTHER RELEASED PARTIES SHALL NOT BE LIABLE IN ANY WAY FOR ANY SUCH CLAIMS, ACTIONS, INJURIES, LOSS OR DAMAGES.
THE SPONSOR IS NOT RESPONSIBLE FOR TYPOGRAPHICAL OR OTHER ERRORS IN THE OFFER OR ADMINISTRATION OF THE PROMOTION, INCLUDING BUT NOT LIMITED TO ERRORS IN ADVERTISING, THE OFFICIAL RULES, THE SELECTION AND ANNOUNCEMENT OF THE WINNERS OR THE DISTRIBUTION OF THE PRIZES, NOR IS THE SPONSOR RESPONSIBLE FOR ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY SITE USERS OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE PROMOTION OR BY ANY TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE PROCESSING OF ENTRIES IN THE PROMOTION.
BY ENTERING THE PROMOTION, ENTRANT AGREES (UNLESS PROHIBITED BY APPLICABLE LAW) THAT: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR IN CONNECTION WITH THE CONTEST, OR ANY PRIZES AWARDED, SHALL BE RESOLVED INDIVIDUALLY WITHOUT ANY RESORT TO ANY FORM OF CLASS ACTION; (2) ANY CLAIMS JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED IN ENTERING AND PARTICIPATING IN THE PROMOTION, BUT IN NO EVENT ATTORNEYS' OR LEGAL FEES; AND (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED AND ANY OTHER DAMAGES, OTHER THAN DAMAGES FOR ACTUAL OUT-OF-POCKET EXPENSE.
THE SPONSOR IS NOT RESPONSIBLE FOR TECHNICAL, HARDWARE, SOFTWARE, ONLINE, INTERNET OR TELEPHONE FAILURES OR MALFUNCTIONS OF ANY KIND, LOST OR UNAVAILABLE NETWORK CONNECTIONS, OR FAILED, LOST, INCOMPLETE, GARBLED, OR DELAYED ENTRIES OR COMPUTER TRANSMISSIONS WHICH MAY LIMIT OR INTERFERE WITH A PARTICIPANT'S ABILITY TO TAKE PART IN THE PROMOTION. IN ADDITION, SPONSOR SHALL NOT BE RESPONSIBLE FOR ANY DAMAGE TO ANY COMPUTER OR OTHER PROPERTY RESULTING FROM PARTICIPATING IN, OR DOWNLOADING ANY MATERIALS FOR, THE PROMOTION.
DISPUTES: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of any entrant and Sponsor, shall be governed by and construed in accordance with the laws of the state of Arkansas and the federal laws of the United States, without giving effect to any choice of law or conflict of law, rules or provisions that would cause the application of the laws of any jurisdiction other than the state of Arkansas. The parties submit to the exclusive jurisdiction of the courts in the County of Sebastian, Arkansas.
